Lauren Turner is part of a multi-firm team that recently had five big wins in the Tennessee Court of Appeals arising from a 2016 Chattanooga school bus accident that has made national news, Wikipedia, and continues to make news locally. In defending a national bus company against claims for negligent infliction of emotional distress and reckless infliction of emotional distress, Lauren and the defense team argued on a Rule 10 extraordinary appeal by permission that the plaintiffs were not proper parties, because they did not fall within the reasonably foreseeable scope of persons entitled to bring such claims. The Court of Appeals discussed and analyzed Tennessee case law on negligent and reckless infliction of emotional distress claims, and held that the plaintiffs were not proper plaintiffs, thereby limiting the scope of plaintiffs in emotional distress cases in Tennessee. The Court of Appeals reversed the trial court decisions denying the respective Motions to Dismiss, and remanded the five cases for dismissal.
