This Plaintiff brought a premises liability claim against a large grocery retailer. As there was no evidence to support a comparative negligence defense, Lee Weatherly and Kierra Brown focused on a causation defense. Because Plaintiff submitted over 1M in special damages, Lee and Kierra retained an expert orthopedic surgeon to evaluate Plaintiff’s claims. This expert ultimately opined that some of Plaintiff’s claimed treatment was unrelated to the subject incident. Plaintiff submitted a demand for 7.5M, Lee and Kierra secured a settlement equating to less than 4% of the demand.
