Lee Weatherly and Kierra Brown secured Summary Judgment for a national grocery chain in a premises liability case. The plaintiff alleged a fall caused by an exposed tree root, but during discovery, she admitted that exposed tree roots on unpaved ground near trees was a foreseeable, open and obvious condition. Additionally, Lee and Kierra presented clear photo and video evidence as well as expert opinions which all pointed to a biomechanical failure as the cause of Plaintiff’s fall as opposed to the existence of an actual hazard. The court agreed, dismissing the case with prejudice.
