EEOC Discrimination Charge Dismissed for Local Business
W. Matthew Wayne and Robert Norton recently secured dismissal of federal and state claims of gender discrimination and retaliation filed against a Hamilton County business via the Equal Employment Opportunity Commission (EEOC). Upon discharge, the employee filed claims with the EEOC alleging offensive remarks, exclusion based on gender, and retaliation after allegedly reporting a subordinate.
Our team worked directly with company leadership to investigate, respond quickly, and defend the business and filed a well-received brief supporting the dismissal. A critical factor in the victory was the company’s employee handbook and workplace protections, which we used to show the termination was legitimate and not discriminatory, along with employee testimony. With these defenses and additional arguments, we obtained dismissal of all claims.
The takeaway: well-drafted handbooks, policies, and agreements are not just paperwork—they can be your first line of defense against expensive and disruptive claims.
