Lee Weatherly and Kierra Brown resolve rear end motor vehicle accident cases for less than 10% of Plaintiffs’ Demand
Lee Weatherly and Kierra Brown secured a settlement for a corporate client and its employee driver in a rear end accident case for less than 10% of Plaintiffs’ demand. Lee and Kierra developed a liability defense centered on Plaintiffs’ unfamiliarity with the area and confusion about how the accident happened to argue that the Plaintiffs actually cut off the Defendant, causing the rear end accident. Lee and Kierra were also able to take the driving Plaintiff’s prior driving record and recent failure of a drug test to also claim comparative negligence against the passenger Plaintiff for negligent entrustment of her vehicle. Lee and Kierra were also able to attach comparative negligence to the passenger Plaintiff using the joint venture doctrine. Lee and Kierra then attacked the driving Plaintiff’s 1.5M million dollar life care plan by using expert testimony. The life case plan was essentially eliminated from settlement negotiations and Plaintiffs eventually agreed to settle the matter for less than 10% of their initial demand, which was less than the cost of defense of trying the case.
