Melissa Bailey and Fred Valz won summary judgment in a bad faith and breach of contract case in the Middle District of Georgia, Albany Division.  A deceased motorist’s estate sent a policy limits demand following the carrier’s proactive tender of the policy limits following a multi-fatality accident.  The estate later obtained a seven-figure verdict and argued the carrier acted in bad faith in rejecting its demand.  The federal court ruled there was no bad faith or breach of contract as a matter of law and dismissed all claims against the carrier, awarding statutory costs to the carrier.
