Melissa Bailey and Corey Mendel won a motion for judgment on the pleadings in a lawsuit filed in Cobb County against their engineer client.  The suit claimed our client prepared and stamped civil drawings for an adjacent parcel resulting in injury to property, asserting claims for fraud, theft, conspiracy, and RICO.  Our motion successfully argued the allegations of the complaint, taken as true, had not alleged facts sufficient to support the claims against our client. The trial court agreed, completely dismissing our client from the multi-defendant litigation prior to discovery.
