Angela Kopet and Rebecca Phelan were able to secure the dismissal of their corporate client prior to trial. Multiple plaintiffs filed their Complaint for personal injuries and wrongful death seeking 10 million dollars after they were struck by a vehicle. Angela and Rebecca filed a Motion to Dismiss discussing why the Plaintiffs could not establish negligence against their client focusing on lack of duty and lack of causation and discussing common carrier law. The court ultimately agreed with their position and dismissed all of the claims filed against the company, including the request for punitive damages.
