Court of Appeals Affirms Dismissal of Accountant Client for Failure to Comply with Court Order

A plaintiff attempted to sue Doug MacKelcan and Skyler Wilson’s accountant client for his allegedly erroneous audit of a plaintiff’s tax filings the client performed on behalf of a state entity.  The plaintiff did not serve the client within the constraints imposed by court order.  At the trial level Doug and Skyler argued the failure to comply with the court order rendered service ineffective and their client should be dismissed. The trial court agreed and dismissed the claims against the client, but the plaintiff appealed to the S.C. Court of Appeals.  Doug and Skyler convinced the court of appeals to affirm the trial court’s ruling, and prevented their client from having to deal with costly litigation.
