Plaintiffs, members of an association, sued the association’s board of directors alleging mismanagement of the association’s funds and breaches of fiduciary duty.  Doug MacKelcan and Skyler Wilson obtained summary judgment on behalf of their association board clients based on the statute of limitations and the business judgment rule, arguing that the Plaintiffs knew of the claims but waited too long to bring them, and that the board of directors were insulated from liability for making discretionary decisions.  The Court of Appeals affirmed in a lengthy decision, and the Supreme Court of South Carolina declined the petition for writ of certiorari, ending the appeal.
