Insurance Broker and Firm Dismissed from Suit for Negligent Misrepresentation

Paul Sperry and Skyler Wilson obtained summary judgment for their clients, an insurance broker and his firm, and avoided an expensive trial in federal court over claims of negligent misrepresentation and equitable estoppel.  The broker worked with an insured to obtain insurance on a home under construction, providing the insured with the coverage requested.  The home caught fire when it was almost completed, burned to the ground, and was deemed a total loss.  When the multi-million dollar claimed loss exceeded the available coverage, the insured attempted to hold his insurance broker responsible for the difference.  Paul and Skyler successfully argued the insurance broker did not misrepresent the coverage available or requested, the court agreed, and dismissed their clients.
