Melissa Bailey and Caroline Sims won a motion to dismiss in the State Court of Gwinnett County.  We argued the COVID-19 tolling did not apply to a suit limitations provision in the insurance policy, and the claim was time-barred.  The Court agreed.  The plaintiff attempted to circumvent this ruling by adding a fraud claim, and the Court granted our client’s motion to strike on that issue.
