Mark Lefkow and Erik Haener obtained an Order granting a partial motion to dismiss in federal court on behalf of a motorhome manufacturer in a wrongful death action. They successfully argued that Plaintiffs’ strict liability claims must be dismissed on account of expiration of the statute of repose. Plaintiff argued that the statute of repose was rolled by Georgia’s COVID-19 Emergency Orders. The federal court found that a statute of repose cannot be tolled and was not tolled as to Plaintiffs’ claims.
