Atlanta Partners Anna Beaton and Steve Cohen obtained a favorable verdict at trial in Brantley County Superior Court between March 6-9, 2023. Plaintiff alleged the defendant log truck driver backed out of his driveway, causing her to strike the rear of his trailer. However, eyewitness testimony established the log truck driver was actually turning right into his driveway. Plaintiff was traveling in excess of the posted speed limit and rear-ended the log trailer. The jury deliberated for approximately one and a half hours and apportioned 12% fault to the log truck driver and 88% to the plaintiff. Under Georgia’s modified Comparative Negligence rule, plaintiff’s percentage of fault barred her from recovering any damages.
